What is the Rent Agreement Generator?

A rent agreement records the deal between an owner and the people who will live in their home: who the parties are, which property it is, how long the arrangement runs, the monthly rent, the security deposit and the rules both sides agree to. This generator drafts a residential rent agreement, or a leave-and-licence agreement, in the formal style used across India — a preamble naming the parties, a WHEREAS recital, numbered clauses, a schedule of the property and signature blocks for every party and two witnesses.

Fill in the form and the agreement is written as you type: the end date is worked out from the start date and term, rent and deposit appear in figures and in words, and clauses you have no facts for are simply left out. Switch to a leave-and-licence agreement and every “landlord” and “tenant” becomes “licensor” and “licensee”, with a clause recording that no tenancy is created. How to use it

  1. Choose a rent agreement or a leave-and-licence agreement, and enter the place and date of signing.
  2. Add the owner and up to three tenants with their parent or spouse name, age and address.
  3. Describe the property, its furnishing and, if you like, a list of fittings for the annexure.
  4. Set the start date and term (11 months by default), then the rent, due day, deposit, lock-in and notice period.

Frequently asked questions

Why are most rent agreements made for 11 months?
Under section 17 of the Registration Act, 1908, a lease of immovable property for a term of more than one year, or from year to year, must be registered. An 11-month agreement falls outside that requirement in most states, which avoids the registration fee and a trip to the sub-registrar, and usually means lower stamp duty. Renewal is then a fresh agreement, typically with an agreed increase in rent. State rules still apply: some states require registration of shorter agreements too.
Does a rent agreement need to be on stamp paper?
Yes — an agreement to let property is an instrument that attracts stamp duty under the Stamp Act that applies in your state, and an unstamped or under-stamped agreement cannot be relied on as evidence until the duty and a penalty are paid. The duty is usually a small percentage of the rent and deposit, or a fixed amount, depending on the state. You can buy e-stamp paper (for example through SHCIL where it is available), have plain paper franked at an authorised bank, or use non-judicial stamp paper. Use “Leave space for stamp paper” to print the agreement below the stamp.
When does a rent agreement have to be registered?
Leases for more than a year must be registered with the sub-registrar under the Registration Act. Some states go further: in Maharashtra, section 55 of the Maharashtra Rent Control Act, 1999 requires every leave-and-licence agreement to be in writing and registered, whatever its term, and this can be done online through the state’s e-registration service. Notarising an agreement is not the same as registering it.
What is the difference between a rent agreement and a leave and licence agreement?
A rent agreement (a lease) transfers a right to enjoy the property to the tenant for the term. A leave-and-licence agreement only gives the licensee permission to occupy the premises, and records that no tenancy or interest in the property is created — the form most commonly used in Maharashtra. Choose the type at the top of the form and the wording changes throughout.
Is police verification of a tenant required?
In many cities, orders issued by the local police require owners to submit their tenants’ details for verification, and failing to do so can be an offence. It is usually a short form with the tenant’s ID and photograph, and many state police services accept it online. The agreement includes a clause requiring the tenant to provide the documents needed.
